Assumption of Risk and Jurisdiction Clause FOR EVENT ATTENDEES

1. Assumption of Risk

1.1 By purchasing a ticket for the tour services provided by Secret New York City: A Guide to the Weird, Wonderful, and Obscure author Rossilynne Culgan (the "Tour Provider") in New York City, the purchaser ("Customer") acknowledges and agrees that participation in the tour involves inherent risks associated with walking in an urban environment. These risks may include, but are not limited to, uneven sidewalks, traffic hazards, weather conditions, and other conditions or circumstances commonly encountered in a city setting.

1.2 The Customer voluntarily assumes all risks of injury, harm, or damage that may arise from participation in the tour, whether such risks are known or unknown, foreseeable or unforeseeable, and regardless of whether they result from the negligence of the Tour Provider, its employees, agents, or representatives, or from any other cause.

1.3 The Customer agrees to exercise reasonable care and caution during the tour and to comply with all instructions provided by the Tour Provider or its representatives to ensure their safety and the safety of others.

2. Limitation of Liability

To the fullest extent permitted by law, the Tour Provider shall not be liable for any injury, loss, damage, or expense incurred by the Customer arising out of or in connection with participation in the tour, except where such injury, loss, damage, or expense is caused solely by the gross negligence or willful misconduct of the Tour Provider.

3. Jurisdiction and Governing Law

3.1 This agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.

3.2 Any dispute, controversy, or claim arising out of or relating to this agreement, including its interpretation, performance, or breach, shall be subject to the exclusive jurisdiction of the state and federal courts located in New York, New York. The Customer expressly consents to the personal jurisdiction of such courts and waives any objection to venue or forum non conveniens.

4. Severability

If any provision of this agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect to the extent permitted by law.

In addition: 

  • Indemnification Clause: The Customer agrees to indemnify and hold harmless the Tour Provider from any claims, liabilities, or damages arising from the Customer's actions during the tour.

  • Force Majeure Clause: The Tour Provider shall not be held liable for any delays, cancellations, or changes to the tour schedule caused by events beyond its reasonable control, including but not limited to severe weather, natural disasters, government actions, or public emergencies.
